What the law says

Nothing in the Visa Code imposes a cooling-off period after a refusal. Article 32(5) requires the refusal to be entered in the Visa Information System, and Article 21(2) requires every consulate to consult the VIS for every application, so the next examiner will see the earlier refusal, its date, its state and its ground. Refusals do not expire from the VIS within the retention period, but they are context, not a bar.

Second application: the discipline

  1. Reproduce the ticked ground from the Annex VI form at the top of your own notes and make the new file answer it visibly. A ground-3 refusal followed by the same three months of statements is a second refusal waiting to happen.
  2. Keep everything that was not questioned; change what was. Consulates notice a file that suddenly changes employer, sponsor or purpose.
  3. Address the refusal in the cover letter in one factual paragraph: date, state, ground, and what is different now. Silence looks like concealment because the VIS shows it anyway.
  4. Do not "consulate shop": Article 5 fixes the competent state; applying elsewhere for a trip whose main destination is unchanged is itself a credibility problem.
  5. Consider whether the trip should change. If the ground was 13 (intention to leave), a shorter, more anchored trip after a few months of visible stability answers it better than the same three-week tour next month.

Refused twice, or three times

Repetition changes the reading. Two refusals on the same ground with substantially the same file tell the third examiner that the applicant is not fixing the problem; a third application should be visibly rebuilt or delayed until the facts have changed (a new job, more travel history, a different purpose). If the second refusal was on a different ground from the first, that is progress: the first gap was closed and a new one exposed. Where a consulate has erred on the record, use the appeal route (Article 32(3)) rather than a third file, so the erroneous refusal is corrected rather than accumulated.

Timing and cost

Each application costs the full fee (Article 16) and the outsourcer's charge; none is refunded on refusal (Article 16(7)). Lodge inside the six-month window (Article 9(1)) and leave the 15-to-45-day decision period (Article 23) plus appointment wait before any non-refundable booking.
